Summer Resort Associations

Some homeowners’ associations have been formed under one of the Summer Resort Acts enacted in the early 1900’s. These associations have rights and powers that are somewhat different from general homeowners’ associations not formed under these acts. These entities face different challenges to their existence and their ability to govern based on the statutory language of the Act and how they have developed over the years. They are considered municipal corporations but do not have the full array of powers that other municipal entities possess.
