Sales Disclosure Violations/Fraud

In all residential property sales the seller is required to sign a Seller’s Disclosure Statement as to the known conditions of the property. Many times after the buyer takes possession the buyer will find some defect in the property that was not disclosed. In these cases the buyer will argue that the seller knew of a defect and did not disclose it, that the seller covered up a known defect to avoid detection on inspection, or that the seller should have known about the defect.
