Restrictive Covenants

Some properties are burdened with restrictions on use of the property for the benefit of other property or properties. This is typically seen in subdivisions run by homeowner’s associations, condominiums, and properties originally owned by one person. Only an owner can agree to restrict use of a property, but most restrictions are put in place before the properties are sold so that the buyer knows the restrictions prior to purchase. Any entity or person affected by the violation of the restriction can seek enforcement of the restriction and prohibition of an excluded use.
